<span style="font-family: inherit;">Trucks are harder to find and more expensive than ever
before. We saw a glimpse of things to come during June and July of this year,
but no one could be prepared for how September has progressed. Suddenly, rates
that would once be considered ridiculous for the most straightforward lanes are
to be expected. Options are limited: freight expeditors, who typically charge premiums
over and above market price, are booked days in advance. Truckload carriers of
any size, both temperature control and dry van, are equally hard to come by. </span><span style="font-family: inherit;">As a result, every carrier is prioritizing
the customers it’s willing to serve, based on the return on investment. Case in
point: one large shipper we know called a mandatory conference call for its
primary carrier providers this month to discuss a large number of loads that
were missed – and only a small handful of loyal providers attended the call!</span></div>
</div>

<span style="font-family: inherit;">Shippers are angry and frustrated, and we’re fielding calls
from our customers asking whether things have settled down yet. The answer is a
firm but disappointing “No.” The market for trucks is moving at light speed. As
quickly as availability appears, it’s gone! <o:p></o:p></span></div>
<div class="MsoNormal">
<span style="font-family: inherit;"><br /></span></div>
<div class="MsoNormal">
<span style="font-family: inherit;">For those of us who have the benefit of tenure in this crazy
business, market conditions are reminiscent of third quarter 2003, a crisis
that didn’t let up until 2005. At that time, (2001-2) we were emerging from
recession, and trucking was lackluster. Truck volume was up one quarter, down
the next. President George W. Bush and
Congress passed a stimulus package in the 3<sup>rd</sup> quarter of 2003, giving
rise to an 8.2% GDP for that quarter.
That remarkable and historic increase in spending, coinciding with peak
3<sup>rd</sup> quarter shipping overwhelmed the trucking industry overnight. Shippers went from operating on autopilot, to vigorously
competing with each other for trucks. Core providers disappeared. With capacity
at crisis levels, January 2004 saw new hours of service (HOS) requirements, reducing
the number of hours drivers could drive. As a result, capacity decreased again,
at 3-4% at the worst possible moment. Truckload freight flooded LTL carriers
and trains. Train speed suffered, forcing some freight back to truck. Capacity
was impacted for about a <i>year and a half</i>
before the market caught up. <o:p></o:p></span></div>

<span style="font-family: inherit;"><br /></span></div>
<div class="MsoNormal">
<span style="font-family: inherit;">The current conditions feel similar, with different
variables. I’d argue that we’re looking at a worse situation, and I’ll explain
why. Trucking isn’t nearly as loose as it was in 2003. We’ve experienced a sort
of equilibrium between supply and demand in the market for the last several
years, which makes us more susceptible to disruption. A snowstorm in the West upends the nation’s
supply chain for days- sometimes weeks. Today’s massive hurricanes in the
Caribbean, in Texas and Florida have had a more adverse effect on the market
than the Bush 2003 tax credit. Plus, we’re on the cusp of peak 3<sup>rd</sup>
quarter shipping once again, in the midst of a current capacity crisis, and to
make matters worse – the ELD mandate is upon us. <o:p></o:p></span></div>
<div class="MsoNormal">
<span style="font-family: inherit;"><br /></span></div>
<div class="MsoNormal">
<span style="font-family: inherit;">Conservative estimates place the loss of hours, or
productivity, that the marketplace will experience as a result of the ELD
mandate at 3%-7%. That’s equal to, or more than, what we lost in 2004. <b>And we had more supply in 2004.</b> We’ve
been warning our customers for two years about the ELD mandate, but we couldn’t
have foreseen the impact of the recent hurricane season to disrupt the market
even sooner. <o:p></o:p></span></div>

<div class="MsoNormal">
There’s currently no end in sight, but there are a few recommendations I would implore shippers to consider. You’ll need to be limber in order to keep your business moving, as it’s going to be more competitive than ever. To start, I recommend reexamining budgets throughout your organization, from procurement, to finance, to planning, to customer service, your production facilities, vendors, customers, and please don’t forget about any distribution centers owned or leased. Trust me, you’re not the only company doing this, and some wise organizations are ahead of the curve. Second, your ability to be flexible will be your key to beating out the competition for capacity. Provide as much advance notice as possible, and keep your options open. You may have to push out pickup one day or more – but now is not the time to dismiss availability if you’re lucky enough to find it. The trucking market is as alive as the stock market. It’s far more stable and predictable, but it moves up and down, and nobody—not the largest shippers, the largest carriers, and the largest 3PLs combined, control it. It does what it wants. If you’re able to budget accordingly, incorporate flexibility, and strengthen partnerships with your loyal carrier and broker friends, you’ll be able to weather this crisis, while beating your competitors to the trucks and to the shelves.<br />

tight, in fact, that large trucking firms are turning away hundreds</span> </span>of
loads per day. One of our carrier friends is turning away hundreds of EDI
tendered loads (typically, contract rates and lanes) per week. So what’s going
on? There are more causes than you can shake a stick at, but here are just a
few:</div>

<li>We’re 4 months from the USDOT’s ELD mandate,
expected to remove 5-10% of capacity from an already tight marketplace.</li>
<li><span style="text-indent: -0.25in;">We’re 4 months into the FDA’s Food Safety
Modernization Act (FSMA), which is shuffling the deck of carriers that food
shippers risk using—shifting from owner operators to more sophisticated fleets.
ATA reported in 2016 that only about 5% of the nation’s products move in
temperature controlled equipment. With much of that typically being moved by
owner operators, the shift to more advanced outfits, coupled by higher rates,
are seriously impacting temp control markets. Making things worse for trucking
- but good for our farmers - 2017 was largely a more “fruitful” growing season,
further straining capacity.</span></li>
<li><span style="text-indent: -0.25in;">Major retailers who are trying to catch Amazon
have instituted very aggressive new compliance fees, penalizing suppliers for things
like late deliveries, rescheduled appointments, early deliveries, and so on. A
vendor can get dinged for its carrier being late, and again for rescheduling a
delivery. You can’t argue the need to pace Amazon, but restricting flexibility
during a time of tight capacity - which is only expected to worsen - spells
missed sales, huge fees, unhappy consumers, and a nightmare for retail
suppliers’ customer service teams.</span></li>

Typical reactions to capacity tightening involve shippers using
more intermodal, but maybe not this time. The nation’s third largest railroad,
CSX is having a heck of a time right now as it seeks to revamp its network
toward higher productivity. According to Cowan & Company, “more than 80% of
respondents to a CSX Service Quality survey say they’ve experienced service
issues,” since the switch, and “67% of respondents have transferred freight to
a trucker.” Other reports indicate Jacksonville, Memphis and Atlanta are among
the hardest hit areas. Coincidentally, those markets have been toughest on
truck capacity! <o:p></o:p></div>

you’re not worried, you should be. Even if all of your carriers really are
compliant, they will still be fielding a gold rush of calls from other shippers
whose carriers aren’t. In brief: the ELD
Mandate requires all commercial motor vehicles to be equipped with technology
which tracks drivers’ hours of service before December 18, 2017. ELDs replace
paper logs, which are fraught with errors. Despite having 3 years notice, many
experts estimate that nearly 50% of all commercial motor vehicles still haven’t
met the ELD requirement, a mere four months from the mandate. Every buyer of
freight will be impacted if even a small portion of those currently
noncompliant carriers choose to leave the industry. And compliant carriers lush
with load offers will likely give their trucks and drivers to the highest
bidders.</span><o:p></o:p></div>

When the mandate takes effect, two things are certain.
First, many carriers won’t be ready, and will be placed out of service until
they become compliant. That means other shippers and brokers will pay top
dollar to steal your carriers and your capacity from you. Secondly, experts who
are studying the impact of converting paper logs to ELDs find some fleets are
driving 100-120 additional miles per day! That’s nearly 20% excess/illegal
hours. If 50% of fleets lose 20% of miles, it’s as if 10% of the nation’s
capacity disappears. Even if it’s only 5%, it’s a heck of a lot worse of an
impact than the 2003-2004 crisis, when hours of service were reduced. <o:p></o:p></div>

A challenge to delay the ELD mandate failed in the U.S.
Supreme Court in June. A bill was introduced in the House of Representatives
(HR 3282) which is designed to delay the mandate. The bill does not have
support of house or committee leadership, and there’s no support in the Senate.
To put it simply: it’s doomed to fail. Planning a business around a delayed ELD
mandate is a fool’s game. </div>

In late 2016, truck capacity began disappearing quickly, where even expediting truckers, who charge significant premiums over market pricing, were booked days in advance. <o:p></o:p></div>

In 11 months, the ELD mandate takes hold, requires every truck using paper logs to be converted to electronic logging devices, “ELDs.” So what’s the big deal? A large cold-chain carrier executive visited us, discussing recent acquisitions it made, indicating the carriers it acquired who used paper logs were doing 30% more miles than its ELD-equipped fleet. Yes, that’s 30% more miles than ELD fleets!!! <o:p></o:p></div>

A recent study by Truckstop.com, which was reviewed at their Connected 2016 conference in November, detailed surveys from drivers showing about 5% of them would choose to exit the industry rather than convert to using ELDs.<o:p></o:p></div>

ELDs will undoubtedly reduce miles driven by the nation’s aggregate fleets. Will it be 12-14% like many experts have stated? Might it be more? Might it be only half as bad, like 6-7% reduction in available trucks? <o:p></o:p></div>

Today’s trucking industry and U.S. inventory levels are as finely tuned as they’ve been in history, largely due to technology. The difference between a soft 2016 and a “Katie, bar the doors” capacity starved moment is usually just a snowstorm away. In a discussion with Scott Moscrip, the founder and chairman of Truckstop.com, he told our CEO Jeff Tucker, that in late 2017, his data shows the U.S. experiencing the worst capacity shortage we’ve ever seen. Moscrip said, (paraphrased) it won’t be give me a truck—I don’t care what the price is. It may be that there simply won’t be a truck at any price. He’s not alone. Many of the experts we’ve been talking with are painting a grim picture for truck capacity. If late 2016 is any indication of what’s to come, better prepare now. How? <o:p></o:p></div>

for-hire carriers continued to climb through 2016, with the exception of a decline between October 2015 and January 2016. By June 2016, historical highs were achieved, and have grown each month since then. Analysts often tell stories regarding an uptick in trucking bankruptcies, however, the industry’s net growth tells the fuller story. Examining where the growth occurred, it was in fleets of all sizes, but especially in smaller fleets. Major trade journals often cover stories telling of major consolidations primarily focusing on the largest fleets (500+) trucks. The larger fleets have seen stable numbers over the past four years. <o:p></o:p></div>

While 2016 was fairly soft most of the year, capacity tightened dramatically in the 4<sup>th</sup> quarter. One segment of trucking fared far better than the rest, all year—<b>temperature control</b>. If you ship using temperature controlled equipment, it’s likely that the next 10 years will be exceptionally challenging for you. <o:p></o:p></div>
<div class="MsoNormal">
Factors driving the higher demand for temperature-controlled freight include: (a) increased adoption of whole foods, organic foods, gluten-free and other products that spoil more quickly than others; (b) FDA’s Food Safety Modernization Act (FSMA) increased the burden on food shippers, carriers and even brokers, to control temperature and better protect food; (c) a rush by over-the-counter product manufacturers and homeopathic manufacturers to guarantee controlled room temperature (CRT) throughout the manufacturing stages, through transportation, right up to the delivery to the retailer. As manufacturers require products to be transported as temperature controlled shipments, clean, dry and odor free capacity could come at a much higher cost, if it’s even available.<o:p></o:p></div>
<div class="MsoNormal">
Expect truck shortages and rate increases far worse than the dry van sector due to rapid industry consolidation and more private equity flowing into the temperature controlled arena. In fact, it’s already begun and is expected to continue for many years. Another thing to expect is deteriorating quality from some of the larger refrigerated transportation providers. As their options for pricing and maximizing their ROI can be solid far into the foreseeable future, customer service may take a back seat. <o:p></o:p></div>

Essentially, this means drivers will no longer have written log books, and errors contained on those logs will disappear. The ELDs, when calibrated properly, will demonstrate with certainty, how many hours a driver may drive.<br />
<br />
This is a major development in capacity, and in freight security. The fines carriers receive from law enforcement for breaking hours of service are severe, and will likely continue to worsen. Likewise, shippers will undoubtedly see changes in carrier behaviors that might seem frustrating. For example, in heavy traffic, or delayed by weigh station, a driver may run out of hours just minutes from pickup or destination, and shut down (as they should anyway). With the new “Driver Coercion” laws in effect, pressuring the driver or carrier to proceed, in the name of service, timeliness or safety will land someone in jail!<br />
<br />
It’s all part of a seismic shift in how we understand the freight transportation market, and how we manage our businesses. The new regulatory and supply/demand dynamics require new thinking, and savvy planning and communication among business partners. Some experts who study disparities between traditional logs and ELDs, have found as high as double-digit percentage errors between the two. Whether it’s a percent or two, or 10% or more, you should plan on capacity disappearing over the next 23 months, with the conversion from paper to ELD. How solid is your capacity? FMCSA is preparing to repost its “absolute measure” CSA scores, weeks after the FAST Act required FMCSA to remove from public view CSA’s alert symbol; each of the five relative BASIC scores; and the intervention threshold for each score. While it is not illegal for FMCSA to post these absolute scores, doing so represents an affront to the intent of Congress, in passing the FAST Act, and reintroduces the uncertainty about the use or non use of these scores in play. This harms safety, and isn’t in the public interest.<br />
<br />
FMCSA defends its move, pointing to this paragraph in the FAST Act -- Sec. 5223 (c) CONTINUED PUBLIC AVAILABILITY OF DATA.— “Notwithstanding any other provision of this section, inspection and violation information submitted to the Federal Motor Carrier Safety Administration by commercial motor vehicle inspectors and qualified law enforcement officials, out-of-service rates, and absolute measures shall remain available to the public.” FMCSA interprets “shall” as “must” regarding these scores. Our trade association representatives in Washington have spoken with relevant Congressional leaders this week, who disagree with FMCSA’s interpretation, but neither are they surprised.<br />
<br />
CSA’s BASIC scores, their weighting and their methodology have proven to be unsound and in need of extensive review. It took years and an act of Congress for FMCSA to remove the scores from public view, so that shippers, brokers and the public don’t rely upon them to make commercial carrier selection decisions. By publicly posting absolute measures instead of relative measures, FMCSA is intentionally muddying the waters--again.<br />
<br />
Congress’ intent in hiding CSA BASIC scores is clear—it’s to stop the public from relying upon CSA scores for commercial carrier selection purposes, and to send the BASICs back for increased study. The parties who introduced and pushed the FAST Act language did so for exactly this reason. Congress passed the law for this reason. It appears once again, the only fix to FMCSA’s continued muddying of the waters is to seek a Congressional mandate, by hitting Capital Hill again. <br />
<br />
Tucker’s position is that FMCSA’s “absolute measures” are absolutely useless to the public, for any purpose. Meanwhile, FMCSA is busy at work on a new Safety Fitness Determination (SFD) which will apply an algorithm to all 7 BASICs (even the 2 the public can’t see), to determine “unfit” carriers. The fact that their algorithm isn’t final, and the public won’t ever be able to apply a final algorithm (because 2/7 of the scores are hidden), and accidents will not be predicted, is further evidence that the scores are useless. If FMCSA’s decisions and reactions to criticism weren’t so harmful to public safety, they could be the stuff of a sitcom. Stay tuned.<br />

Recent years have shown far stronger growth, consistently, which has put a continual strain on truck capacity.<br />

Exceptions? Absolutely! For niche and specialty carriers, like temp control, high insurance requirements, teams, etc., the lull has been less. Recent storms ratcheted up capacity concerns very quickly again. The lesson for now is that capacity can tighten very quickly, with a trucking market very close to balanced.<br />
<br />
ATA’s call is that inventories will begin to fall, strong consumer spending will continue (representing about 70% of GDP, and GDP growth is estimated to be 2.6-2.8%, higher than 2015. If it’s true, 2016 could be another challenging year.<br />

The fact is, since early 2012, the number of for-hire drivers has increased by 409,286, representing a 21% increase, and bringing the total number of drivers to 2,354,547. This is a huge story that nobody’s talking or writing about.<br />
<br />
Ask the largest carriers if there’s a driver shortage ─most will say “absolutely.” And they’re right, from a certain limited point of view. The biggest carriers have a very hard time filling seats and keeping them filled. So yes, there’s a driver shortage if you’re a large carrier. No doubt.<br />
<br />
Ask the largest shippers if there’s a driver shortage. Most will say “yes.” And they’re right, too. The biggest shippers often deal with the biggest carriers, keeping a number of the nation’s largest 100 carriers on speed dial. So by definition, the biggest shippers, because they make heavy use of the biggest carriers, have a driver shortage.<br />
<br />
So where are the 409,000+ new drivers? Since 2012, they’ve largely supercharged growth in the micro-, small and mid-sized fleets. For example, the number of micro-fleets (1-6 trucks) increased by 42%; the number of small fleets (7-9 trucks) increased by 29%; mid-size (20-100 trucks) increased by 22%. While during that time the number of larger fleets (101-500) grew 14% and the largest (501+) grew by 10%. Every fleet size grew since 2012, but the clear winners of the driver war are the smaller and mid-size fleets.<br />
<br />
The takeaway: align yourself with smaller and mid-size fleets, and brokers who specialize in the thriving middle of the market. Establish strong partnerships and open lines of communication. Some words of caution regarding the big name brokers—they make prolific use of owner operators. You’ve got to ask yourself—is that the kind of capacity you need? Is that the kind of capacity a business can rely upon?<br />

Shipper practices significantly impact the movement of cargo, the positioning of equipment, and ensure safe practices are followed. The best practices impact these things in a positive manner, and also foster honesty, fairness and openness in business dealings with carriers and drivers. Good carrier and driver practices, in turn, promote fair business dealings, increase compliance with shipper protocols, provide safe services, and ensure drivers conduct themselves professionally and responsibly. Flooding in Texas, fog and snow out West, left shippers, brokers and carriers scrambling to cover, recover and recover again, loads left behind because trucks hadn’t been able to unload. Weather in one part of the country quickly cascades into capacity changes in other parts of the country. The smart play is to understand your volumes, understand your capacity, collaborate regularly with your service providers, and make your freight as attractive as possible. Haddonfield is also where the first largely intact dinosaur skeleton was found in 1858, named, Hadrosaurus foulkii. “Halloween” movie fans may recall the movie was set in fictional Haddonfield, IL (Debra Hill, the original movie’s co-writer grew up in Haddonfield, NJ).
